Please read these Terms and Conditions carefully before accessing or using the Site.

This website (the “Site’) is owned and operated by Bakelaar Jewellers Limited (the “Company”, “we”, “our”, and/or “us”). The underlying code, design, and software are owned by Lightspeed Commerce Inc., the provider of our e-commerce platform.

We sell and distribute jewellery from many third-party suppliers, including Canadian Maple Leaf Diamonds, Lab Diamonds, Madani, Fine Gold and Silver Jewellery, Bulova Watches, Seiko Watches, Waterford, and Wedgwood. As such, certain content and products available on the Site are provided from our third-party suppliers, partners, affiliates, vendors, providers, and distributors (“Third Party” or “Third Parties”).

1. Acceptance of Terms and Conditions

By accessing and/or using any part of the Site, you are indicating that you have read, understood, and agree to be subject to all terms, conditions, and policies contained herein (the “Terms and Conditions”), as well all further terms, conditions, and policies referenced herein. These Terms and Conditions create a binding agreement between you and Company.

Your access to and use of any content originating from any Third Parties may be subject to separate terms, conditions, and policies. In such instances, you agree that you will be bound by the respective terms, conditions, and policies set out by such Third Parties.

2. Modification of Terms and Conditions

The Company reserves the right to modify, update, remove, and/or substitute any part of these Terms and Conditions at any time and at its sole discretion. Any such changes will be posted on the Site with the effective date displayed at the top of the page. It is your responsibility to review the Terms and Conditions periodically. Your continued use of the Site after the implementation of the changes indicates that you accept and agree be to be bound by such updated Terms and Conditions.

3. Use of the Site

This Site and its products are offered to users who are 18 years of age or older. Users under 18 years of age may access and use the Site only with the consent of a parent or guardian.

To access the Site or certain features we offer, you may be asked to provide personal information for the account registration process. You agree to provide personal information that is accurate, current, and complete. Our use of your information is governed by our Privacy Policy, the terms of which are incorporated into these Terms and Conditions.

You are solely responsible for maintaining the security of your login credentials. You must keep your username and password confidential. You acknowledge that you are solely responsible for all activity on your account and you accept full responsibility and liability for any purchases made through your account. If any unauthorized access to your account occurs, or you know or suspect that your login credentials have been compromised, you must notify us immediately.

4. Termination/Suspension of Use

The Company reserves the right at all times to terminate, limit, or suspend your account and any associated access and use of the Site, without notice and at its sole discretion, for any conduct we believe is harmful, unlawful, or otherwise in violation of these Terms and Conditions.

5. Personal Information

The collection, use, and disclosure of any information by the Company is governed by our Privacy Policy. By accessing and using the Site, you acknowledge that you have read, understood, and agree to be subject to the terms and conditions of the Privacy Policy.

6. Intellectual Property

All content, materials, and products displayed on the Site, including but not limited to all text, graphics, images, video, audio, logos, design marks, registered and unregistered trademarks, and software are the property of the Company, its licensors, and/or Third Parties.

Any download, display, and/or print of the Site’s content shall be for your personal, non-commercial use only. Unauthorized use of any of the Site’s content is strictly prohibited and may violate applicable copyright, trademark, and other intellectual property laws.

The Company will actively monitor for any unauthorized use of its intellectual property and reserves the right to pursue legal action against any party that unlawfully uses or reproduces the materials displayed on the Site.

7. Liability of the Company

In no event shall the Company, its affiliates, licensors, employees, agents, representatives, officers, or directors be held liable for any injuries, losses, claims, or damages of any kind arising out of the use, or inability to use, the Site, any content displayed on the Site or content linked to websites owned by Third Parties, and/or any resources, products, or services obtained from the Site or the websites owned by Third Parties.

We make no representations about the accuracy or reliability of the information provided on the Site, nor do we make any representations about the accuracy of any information displayed on the Site that is originating from a Third Party or any information you may obtain from any links on the Site directing you to any other website, including the website of a Third Party. You are responsible for verifying the information before making any purchase. By purchasing from our store, you agree to assume all risks associate with the use of our products.

You agree to indemnify and save harmless the Company, Lightspeed Commerce Inc., and the Third Parties, and their respective affiliates, licensors, employees, agents, representatives, officers, and directors from and against any and all claims, demands, expenses, losses, causes of action, lawsuits, damages, and/or liabilities that are in any way related to the Site or its contents.

8. Shipping and Handling

Should you wish to purchase any products available on the Site, you may be asked to provide personal information, including but not limited to your credit card information (Visa, Mastercard), your billing address (which must match your payment method), and your shipping address, in order to complete the transaction. To facilitate such a transaction, you agree to provide information that is current, accurate, and complete. By providing such information, you consent to the Company disclosing your personal information with any Third Parties who require the information to process the transaction. Once you place an order using the Site, the Company will notify you via email within four (4) to seven (7) business days with a shipping and delivery update. Our shipping periods are Tuesdays through Fridays. All orders received after 11:00am on any of those days will be processed on the next business day.

Before orders are shipped out, they are inspected for quality control and are professionally packed. To ensure that our fragile products arrive safely, all orders are packed with extra packaging. Therefore, it is not possible to offer gift packing for delivery orders.

When you place an order on the Site, you agree to pay all charges incurred, including but not limited to the price of the product in effect at the time of purchase and the standard shipping and handling charges in accordance with the rates/terms below:

Any orders shipped outside of Ontario are subject to the applicable sales tax of the destination province;

For deliveries to Yukon, Northwest Territories, and Nunavut, additional shipping charges will apply.

The Company does not currently offer product shipment and delivery outside of Canada. Should you see something on the Site that you cannot currently obtain in your country, please contact us directly.

9. Returns

It is our priority to ensure that you are satisfied with your product.

If you are not satisfied with a product purchased online from our store, you may follow the return process set out in our Return Policy.

10. Severability

If any part of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall be severable from this agreement and shall not affect the validity or enforceability of any of the other provisions contained herein.

11. Entire Agreement

The Terms and Conditions, Privacy Policy, Return Policy, and any further terms, conditions, and policies incorporated or referenced herein constitute the entire agreement between you and the Company with respect to the Site and shall supersede all prior and contemporaneous agreements, understandings, and communications between you and the Company.
